Terms of Sale

1. Purpose and Scope
These Terms of Sale (ToS) govern all commercial transactions carried out on the GOROGOO platform between sellers and buyers. They apply to any order placed on gorogoo.com and constitute, in accordance with the OHADA Uniform Act on general commercial law, the contract binding the buyer to the seller. Any order implies full and complete acceptance of these ToS.
2. Identification of the Parties
GOROGOO is a marketplace published and operated by HOGOIN SARL, a limited liability company under Beninese law, with its registered office located in Awakè, Godomey, Abomey-Calavi, Atlantique Department, Republic of Benin, registered with the Trade and Personal Property Credit Register of Abomey-Calavi under number RB/ABC/26 B 11921 (IFU 3202617408637). GOROGOO acts as an e-commerce intermediary between third-party sellers and buyers, in accordance with articles 133 et seq. of the Benin Digital Code (Law No. 2017-20 of 20 April 2018).
3. Prices and Taxes
Prices displayed on GOROGOO are expressed in the currency according to the user's preference. For sellers based in the Republic of Benin, prices include Value Added Tax (VAT) at the legal rate in force of 18%. Sellers are responsible for tax compliance in their country of residence. GOROGOO reserves the right to change prices at any time, it being understood that the applicable price is the one displayed at the time the order is confirmed.
4. Order Process
The order is deemed firm and final upon payment validation. The buyer receives an automatic confirmation email serving as an acknowledgment of receipt. The sales contract is formed between the buyer and the third-party seller; GOROGOO is not a party to the sales contract. In accordance with article 140 of the Beninese Digital Code, the buyer can view their order history from their personal area.
5. Payment
Payments are secured via FedaPay, a certified payment provider (Visa/Mastercard bank card, MTN Mobile Money, Moov Money). GOROGOO does not store any banking or card data on its servers. In the event of a payment failure, the order is automatically cancelled. Funds are held in an escrow account and paid to the seller within 7 business days after delivery confirmation.
6. Delivery
Delivery times and fees are defined by each seller and displayed before confirmation. GOROGOO offers an integrated parcel tracking system accessible via gorogoo.com/suivi. Sellers undertake to ship orders within the announced timeframe. In the event of a delay exceeding 7 days without justification, the buyer may request cancellation and a full refund.
7. Right of Withdrawal
In accordance with the provisions of the Beninese Digital Code and OHADA consumer law, the buyer has a period of 7 clear days from receipt of the parcel to exercise their right of withdrawal, without reason or penalty. The return of products is at the buyer's expense unless the product is defective or does not match the description. Downloaded digital products, custom-made products, and perishable goods are excluded from the right of withdrawal.
8. Warranties and Seller Liability
Sellers warrant that the products offered match their description, are in good condition, and do not infringe any intellectual property rights. Any counterfeit, unlawful, or dangerous product is prohibited. GOROGOO reserves the right to immediately remove any non-compliant product and to suspend the account of the seller concerned. The legal warranty of conformity applies in accordance with OHADA principles.
9. Buyer Protection
GOROGOO offers buyer protection on all eligible transactions: refund if the parcel is not received within 30 days, refund if the product does not match the description, and free mediation in the event of a dispute. To activate protection, the buyer must report the issue via their orders area within 15 days following the estimated delivery.
10. Disputes and Competent Jurisdiction
In the event of a dispute, the parties undertake to seek an amicable solution within 15 days. Failing this, the dispute will be submitted to the competent jurisdiction of Cotonou, Republic of Benin, and governed by OHADA law and Beninese law. For cross-border disputes, the parties may resort to mediation by the OHADA Common Court of Justice and Arbitration (CCJA).
11. GOROGOO Commission
GOROGOO charges a commission on each sale made via the platform, according to the pricing plan subscribed to by the seller. This commission is automatically deducted from the amount paid to the seller. Details of applicable commissions are available on the Pricing page.
12. Amendments to the ToS
GOROGOO reserves the right to amend these ToS at any time. Amendments take effect upon publication on the platform. Registered users will be notified by email 15 days before any substantial change. Continued use of the platform after notification constitutes acceptance of the new terms.

These ToS are established in accordance with the OHADA Uniform Act on general commercial law, the Law No. 2017-20 of 20 April 2018 establishing the Digital Code in the Republic of Benin, and the general principles of consumer law applicable in West Africa. In the event of a conflict between language versions, the French version prevails.
